Before hiring any marketing agency, there’s a question worth asking that most people forget until it’s too late: if we part ways, what do I actually keep? Your website, your ad accounts, your customer data, your content — do you own them, or does the agency? It’s an awkward question to raise, but a good partner will welcome it. Here’s what you should expect to own, and what to put in writing.
Your ad accounts and pixel data
Your Meta and Google ad accounts should be owned by you, with the agency given access — not the other way around. If an agency runs your ads inside their account, you can lose every bit of audience and conversion history the day you leave. Insist on your own Business Manager and ad accounts, with the agency added as a partner.
Your website and domain
You should own your domain name and your website files or store. Be wary of any arrangement where the agency holds the domain registration or won’t hand over admin access — that’s leverage over you, not a service to you.
Your customer and lead data
The leads and customers generated are yours. Your CRM, email list, and contact data should sit in accounts you control and can export at any time. This is your most valuable asset — never let it live only in someone else’s tool.
Your content
Clarify who owns the photos, videos, copy, and creative produced for you. Reputable agencies hand over the assets they create for you. Get it in writing so there’s no ambiguity later.
The questions to ask before you sign
- Are the ad accounts and Business Manager in my name?
- Do I own my domain and have admin access to my site?
- Is my CRM and lead data exportable and mine to keep?
- Do I own the creative and content you produce?
- If we part ways, what’s the offboarding process?
If an agency hesitates on any of these, treat it as a red flag.
